Terms of Service
These terms govern your use of the PassPrep platform. Please read them before creating an account. By using PassPrep, you agree to these terms.
1. About PassPrep
PassPrep ("we", "us", "our") is an online exam preparation platform for Australian students preparing for private school scholarship and selective entry examinations, including Edutest and ACER assessments. The platform is accessible at passpreponline.com.au.

2. Acceptance of Terms
By creating an account, making a purchase, or using any part of the PassPrep platform, you confirm that:
- You are at least 18 years of age, or are a parent or legal guardian acting on behalf of a minor
- You have read and understood these terms
- You agree to be bound by these terms and our Privacy Policy
If you are using PassPrep on behalf of a child, you accept these terms on your own behalf and on behalf of that child, and you are responsible for their use of the platform.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and current information when creating your account
- Notify us immediately at hello@passpreponline.com.au if you become aware of any unauthorised use of your account
- Not share your account credentials with any other person
- Not create more than one account per person without our written permission
4. Subscriptions and Billing
Subscription tiers
PassPrep offers a free tier and paid subscription tiers (Standard and Premium). Paid subscriptions are billed on a monthly basis. Current pricing is displayed on the PassPrep pricing page and may be updated from time to time.
Payment
Payments are processed by Stripe, Inc. By providing payment details, you authorise PassPrep to charge the applicable subscription fee to your nominated payment method on a recurring monthly basis until you cancel.
Cancellation
You may cancel your paid subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date. We do not provide pro-rata refunds for partial billing periods, except where required by Australian Consumer Law.
Price changes
We will provide at least 30 days notice of any price increase by email. Continued use of a paid subscription after the effective date of a price change constitutes acceptance of the new price.
5. Free Tier
The free tier provides limited access to practice tests and platform features. We reserve the right to modify the features available on the free tier at any time. We will provide reasonable notice of material reductions to free tier features.
6. Acceptable Use
You agree not to:
- Use the platform in any way that violates applicable Australian law or regulation
- Share, resell, sublicense, or distribute PassPrep content or materials to third parties
- Attempt to gain unauthorised access to any part of the platform or its underlying systems
- Use automated tools, bots, or scraping software to extract content from the platform
- Upload or transmit any content that is unlawful, harmful, defamatory, or infringes the rights of others
- Attempt to reverse-engineer, decompile, or otherwise derive source code from the platform
- Use the platform for any commercial tutoring or resale purpose without our express written consent
- Interfere with or disrupt the integrity or performance of the platform
We reserve the right to suspend or terminate accounts that violate these conditions without refund.
7. Platform Content and Intellectual Property
All content on the PassPrep platform — including practice questions, explanations, essay prompts, blog articles, and user interface elements — is owned by or licensed to PassPrep and is protected by Australian copyright law.
Your subscription grants you a personal, non-transferable, non-exclusive licence to access and use platform content for your own private, non-commercial exam preparation purposes. This licence does not permit copying, reproducing, or distributing content outside the platform.
Any feedback, suggestions, or ideas you provide to us may be used to improve the platform without obligation to you.
8. AI-Generated Feedback
PassPrep's written expression marking uses artificial intelligence to assess student essays and provide feedback. This feedback is generated automatically and is intended as a learning tool to guide practice — it is not a guarantee of performance in any actual examination.
AI-generated feedback may occasionally contain errors or inconsistencies. It should not be the sole basis for preparation, and we encourage students to supplement it with teacher or tutor review where possible.
PassPrep makes no representation that AI marking outcomes will correspond to results achieved in any third-party examination.
9. Disclaimer of Warranties
The PassPrep platform is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The platform will be available at all times or free from errors
- Practice test questions will exactly replicate questions used in any third-party examination
- Use of PassPrep will result in any particular exam score or scholarship outcome
10. Limitation of Liability
To the maximum extent permitted by Australian law, PassPrep's total liability to you for any claim arising from or in connection with your use of the platform is limited to the amount you paid to PassPrep in the three months preceding the claim.
PassPrep is not liable for any indirect, incidental, special, or consequential loss or damage (including loss of data, loss of revenue, or loss of opportunity) arising from your use of the platform, even if we have been advised of the possibility of such loss.
11. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited.
If you are a consumer under the Australian Consumer Law, you may be entitled to a remedy (repair, replacement, or refund) if a service fails to meet a consumer guarantee. Our liability for a failure to comply with a consumer guarantee is limited, where permitted by law, to re-supplying the service or paying the cost of having the service supplied again.
12. Third-Party Services
The platform integrates with third-party services including Stripe (payments), Supabase (data), and Resend (email). Your use of these services is subject to their respective terms and policies. We are not responsible for the acts or omissions of third-party service providers.
The platform may contain links to third-party websites. These links are provided for convenience only. We do not endorse or accept responsibility for the content of third-party websites.
13. Suspension and Termination
We may suspend or terminate your account at any time if:
- You breach these terms
- We are required to do so by law
- We reasonably believe your account is being used fraudulently or in a way that may harm other users or the platform
You may close your account at any time by contacting us at hello@passpreponline.com.au. On closure, your data will be handled in accordance with our Privacy Policy.
We may also discontinue the PassPrep service with 30 days notice. In that event, we will provide a pro-rata refund of any prepaid subscription fees for the unused portion of a billing period.
14. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated terms. If you do not accept the updated terms, you may close your account before they take effect.
15. Governing Law and Disputes
These terms are governed by the laws of Victoria, Australia. You and PassPrep submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.
We encourage you to contact us directly at hello@passpreponline.com.au before escalating any dispute. Most concerns can be resolved quickly and informally.
16. General
- Entire agreement. These terms and our Privacy Policy constitute the entire agreement between you and PassPrep regarding your use of the platform.
- Severability. If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
- No waiver. Failure to enforce any provision of these terms does not constitute a waiver of that provision.
- Assignment. You may not assign your rights or obligations under these terms without our prior written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
